ERYC: Beverley – More CPZ Refunds?

Guest Author Andy STRANGEWAY identifies another invalid Controlled Parking Zone (CPZ) – this time in Beverley, within the jurisdiction of East Riding of Yorkshire Council.

While driving through Beverley on Sunday I noted only one sign at the entrance to the Controlled Parking Zone (CPZ) on Manor Road:
AS_Manor_Rd_Beverley
and Armstrong Way:
AS_Armstrong_Way_Beverley
This is in breach of legislation as both roads must display a sign at both sides of the road to be lawful.

As a result of East Riding of Yorkshire Council (ERYC) incompetence:

  • The full CPZ is unlawful.
  • All residential permits paid for since the signage came into play were needless – and should be refunded.
  • Anyone issued a parking ticket in the CPZ must receive a refund from ERYC.

If you’ve recently received a PCN for ‘Parked in a disc parking place without clearly displaying a valid discon a street within the Beverley CPZ which had a TSRGD 662 sign close by, then appeal it using this information.

I wish to appeal PCN XXXXXXXX on the following grounds.

The contravention did not occur.
The Traffic Order concerned is invalid.
There has been a procedural impropriety on the part of the Enforcement Authority.

It has come to my attention that the signs within the Controlled Parking Zone do not reflect the Traffic Regulation Order in force as there is no mention of residential parking permits on any signage where I parked.

Hello,

It has come to my attention that the Controlled Parking Zone implemented in Beverley was not implemented correctly and the signs within the CPZ don’t convey the traffic regulation order in force.

I’ve purchased X permits at a total of £XXX. I’ve also paid £XXX for X PCNs. Since I didn’t need to buy a permit and since it has been proven that the PCNs are not legally valid as the zones have not been signed correctly, please can you organise a refund of £XXX.

I would like to register a formal complaint against ERYC for their incompetence, which could cost the tax payer thousands.

ERYC must refund residents who have paid for needless permits and motorists who have been unlawfully fined.

In addition ERYC must ensure that the CPZ  is now made lawful to prevent a further waste of tax payers’ resources.
